By accessing, browsing, or using the Website, or by completing a purchase via the Website, you acknowledge that you have read, understood, and agree to be bound by these Terms and our separate Privacy Policy (which is incorporated by reference) in their entirety. If you do not agree to these Terms, you must not use the Website.

We reserve the right to amend these Terms at any time without notice. Your continued use of the Website after any amendments constitutes your acceptance of the new Terms. The current version will always be displayed on the Website.

3. GOODS AND SERVICES OFFERED
3.1. Nature of Goods
We offer physical products, specifically outdoor products used by outdoor enthusiasts and off-gridders.
3.2. Product Information
We attempt to be as accurate as possible with product descriptions, images, and prices. The User acknowledges they have satisfied themselves that the product is suitable for its intended high-performance use. If a product offered by us is not as described, your sole remedy is to return it in accordance with our Refund and Returns Policy.
3.3. Pricing
All prices are indicated in South African Rand (ZAR) and include VAT where applicable, unless otherwise stated. We reserve the right to change prices without notice.
4. ORDERING AND CONCLUSION OF SALE
4.1. Formation of Contract
A legally binding contract of sale is only concluded when: (i) You electronically submit an order to us; (ii) We process and receive full payment for the goods; and (iii) We accept your offer by formally communicating confirmation and dispatch of the goods.
4.2. Stock Errors
Should a product be sold out after you have paid, we will notify you and either offer a suitable alternative or issue a full refund within three (3) working days.
5. PAYMENT, DELIVERY, AND CANCELLATION
5.1. Payment Methods
Payment for all products can be made via the Payfast gateway, which facilitates various payment methods including Credit Card (Visa, MasterCard), Instant EFT, and other methods supported by Payfast.
5.2. Delivery
Risk of loss and damage to the goods passes to you upon delivery. Ownership of the goods remains with the Provider until full payment has been received. Delivery times are estimates and not guaranteed.
5.3. ECTA Cooling-Off Right (Consumer Sales)
Consumers may cancel any transaction for the supply of goods within seven (7) calendar days after the date of receipt, without reason or penalty. The refund for exercising this right will exclude the direct costs of returning the goods to the Provider.
6. REFUNDS, RETURNS, AND WARRANTIES (CPA Compliance)
6.1. CPA Warranty (6 Months)
All goods are subject to the implied warranty of quality in terms of the Consumer Protection Act 68 of 2008 (“CPA”) for a period of six (6) months.
6.2. Defective Goods Remedy
If goods are found to be defective within six (6) months, you may return them to us at our risk and expense. We will then, at your choice, either (a) repair the goods, (b) replace the goods, or (c) refund the price paid.
6.3. Discretionary Refund/Return Period
Outside of the statutory rights, we offer a discretionary return period of seven (7) business days from the date of receipt for non-defective, unused, and unopened goods. Returns under this period may incur restocking fees.

7. INTELLECTUAL PROPERTY AND USE RESTRICTIONS
7.1. Ownership
The entire content of the Website, including text, graphics, logos, and images, is the property of Mamba Dev (Pty) Ltd or its suppliers.
7.2. Prohibited Use
You may not use the Website, or any content thereof, for any unlawful purpose, or to solicit the performance of any illegal activity.
8. DATA PRIVACY AND POPIA COMPLIANCE
8.1. POPIA Compliance
We are committed to protecting your privacy and complying with the Protection of Personal Information Act 4 of 2013 (“POPIA”).

9. LIMITATION OF LIABILITY AND INDEMNITY
9.1. No Warranties

The Provider, including its directors, employees, and agents, shall not be liable for any direct, indirect, incidental, special, or consequential loss or damage arising from or in connection with the use of the Website or the products sold.
10. GOVERNING LAW AND DISPUTES
10.1. Governing Law
These Terms shall be governed by the laws of the Republic of South Africa.
10.2. Jurisdiction
The User consents to the jurisdiction of the Magistrates’ Court in the event of any dispute. We reserve the right to institute action in the High Court of South Africa.
10.3. Alternative Dispute Resolution
You have the right to resolve any complaint regarding our service or goods through the relevant consumer goods and services ombudsman or the National Consumer Commission.
